1. Structure of Terms & Legal Bindingness

This Terms of Service Agreement (“Agreement” or “Terms”) constitutes a legally binding contract entered into by and between Anakrio AS, a corporation organized under the laws of Norway with organization number/registered postal details at Postboks 60234, 3202 Sandefjord, Norway (“Company,” “Anakrio,” “we,” “us,” or “our”), and any individual, corporate entity, or legal representative (“User,” “you,” or “your”) who accesses, registers for, or utilizes our software-as-a-service (SaaS) platform, APIs, web applications, URL shortening routing infrastructure, call-to-action (CTA) overlay modules, dynamic bio page builders, and associated digital services available via https://anakrio.com (collectively, the “Services”).

BY CREATING AN ACCOUNT, ACCESSING THE DASHBOARD, EXECUTING AN API REQUEST, REDIRECTING TRAFFIC THROUGH OUR DOMAINS, OR OTHERWISE ENGAGING WITH THE SERVICES, YOU UNCONDITIONALLY EXPRESS YOUR FULL CONSENT TO BE BOUND BY ALL PROVISIONS OF THIS AGREEMENT AND OUR INTEGRATED PRIVACY POLICY. IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A LEGAL ENTITY, YOU REPRESENT AND WARRANT THAT YOU POSSESS FULL LEGAL AUTHORITY TO BIND SUCH ENTITY TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES.

2. Service Description & Platform Architecture

Anakrio AS provides an enterprise-grade link management, redirection, telemetry analytics, and custom dynamic landing page ("Bio Pages") hosting infrastructure. The Services allow authorized Users to:

  • Generate shortened, custom-branded URLs and manage server-side dynamic HTTP redirections.

  • Construct customizable, web-accessible bio link pages incorporating media embeds, structured content, and call-to-action (CTA) overlay banners.

  • Access aggregated, anonymized click-stream telemetric reports including geographic, referral, and device-category metrics.

  • Utilize programmatic Application Programming Interfaces (APIs) for link generation and management.

Anakrio AS reserves the right to enhance, upgrade, modify, restrict, or discontinue any feature, endpoint, or functional component of the Services at any time to preserve platform stability, maintain security compliance, or adapt to technological advancements.

3. Account Eligibility, Security & Account Governance

3.1 Age & Legal Capacity

The Services are intended strictly for users who have reached the minimum legal age of majority or are at least thirteen (13) years of age (or the applicable statutory age for digital consent within their primary jurisdiction). If you are between the ages of 13 and the legal age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed, understood, and consented to this Agreement on your behalf prior to account initialization.

3.2 Registration Integrity & Credentials

To access core dashboard functionality and administrative features, you must register a primary account. You agree to:

  • Provide true, accurate, current, and complete registration credentials and corporate identity details as prompted by our registration interfaces.

  • Continuously maintain and promptly update account details to reflect operational changes (e.g., primary email address updates).

  • Maintain strict confidentiality over administrative passwords, two-factor authentication (2FA) mechanisms, and API access tokens issued to your account.

3.3 Unauthorized Access & Liability

You bear exclusive responsibility for all actions, operations, automated API calls, traffic routing, and content deployments executed under your primary credentials or associated sub-accounts. Anakrio AS shall not be liable for any loss, damage, data breach, or unauthorized account manipulation arising from your failure to secure your access credentials. You must notify our Security Operations Unit immediately at support@anakrio.com upon detecting any unauthorized entry, credential leak, or breach of account security.

4. Acceptable Use Policy (AUP) & Abuse Protocols

To protect platform integrity, system reputation, server IP deliverability, and the safety of end-users, you agree to adhere strictly to this Acceptable Use Policy.

4.1 Categorical Prohibitions

You expressly warrant and undertake that you shall NOT, directly or indirectly through automated scripts or third parties, utilize the Services to:

  1. Distribute Malicious Code & Cyber Threat Vectors: Create, shorten, or route traffic to web destinations containing malware, ransomware, spyware, keyloggers, rootkits, drive-by downloads, or rogue software executable files.

  2. Execute Phishing & Social Engineering: Deploy deceptive URL cloaking, domain spoofing, fake login screens, or credential-harvesting pages intended to trick users into revealing sensitive data, financial info, or credentials.

  3. Host Unlawful, Harmful, or Dangerous Material: Publish, embed, or link to content that promotes illegal acts, terrorism, hate speech, extreme violence, non-consensual sexual content, child sexual abuse material (CSAM), human trafficking, or dangerous counterfeit substances.

  4. Infringe Intellectual Property Rights: Upload, display, link to, or distribute proprietary images, copyrighted videos, trademarked assets, software cracks, torrent files, or trade secrets without explicit authorization from the legitimate rights holder.

  5. Transmit Unsolicited Mass Communications (Spam): Utilize short links within bulk unsolicited commercial emails (email spam), automated SMS campaigns, forum comment spamming, social media botting networks, or manipulative search-engine indexing schemes.

  6. Bypass Access & System Integrity: Attempt to gain unauthorized access to our core infrastructure, execute SQL injections, conduct distributed denial-of-service (DDoS) attacks, scrape network assets, or bypass system rate limits and API quotas.

  7. Perform Financial Fraud or Illicit Commercial Activities: Distribute links promoting fraudulent multi-level marketing (MLM) schemes, wire-fraud operations, unverified investment scams, or illicit unregulated gambling platforms.

4.2 Automated Abuse Detection & Immediate Remediation

Anakrio AS employs real-time automated inspection algorithms, machine-learning threat filters, third-party database blacklists (including Google Safe Browsing and Spamhaus), and human safety audits. If an account, shortened URL, or bio page is flagged for violating this AUP:

  • We reserve the unconditional right to instantly disable, block, edit, or purge the offending URL redirection, bio page, or overlay campaign without prior notice.

  • We reserve the right to suspend or permanently terminate the account responsible for the deployment.

  • We reserve the right to report confirmed illegal activities, IP logs, and account identity metadata to competent law enforcement agencies, cybercrime authorities, and regulatory bodies under valid legal process.

5. API Usage, Rate Limits & System Quotas

5.1 Programmatic Access

Access to Anakrio APIs is governed by tier-specific rate limits, request quotas, and security protocols designed to prevent service degradation. You agree to utilize APIs strictly in accordance with official documentation.

5.2 API Key Governance

API keys are confidential security tokens. You may not share, sell, publish, or publicly commit your API keys to public repositories (e.g., GitHub). You agree to implement secure server-side key management.

5.3 Rate Limiting & Overages

Exceeding platform rate limits may result in temporary HTTP 429 ("Too Many Requests") throttling, automatic API suspension, or account reclassification. Repeated, intentional efforts to bypass API throttling mechanisms constitute a severe breach of this Agreement.

6. User-Generated Content (UGC) & License Grants

6.1 Ownership Retention

You retain all pre-existing legal ownership, copyright, and intellectual property rights in and to the content, text, images, graphics, audio, video, custom domain names, and third-party media links that you upload, configure, or embed on your Anakrio bio pages (“User Content”).

6.2 Operational License Grant to Anakrio

By submitting, configuring, or rendering User Content through our platform, you grant Anakrio AS a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to host, cache, store, reproduce, adapt, reformat, translate, publish, publicly display, and distribute such User Content solely to the extent necessary to operate, maintain, deliver, secure, and optimize the Services on your behalf.

6.3 Third-Party Media Embeds & Integrations

Our Services permit the execution and rendering of third-party media players and widgets (including, but not limited to, Spotify, Apple Music, TikTok, and YouTube). You represent and warrant that:

  • You possess all necessary licenses, permissions, and rights to embed, frame, and display such media on your public pages.

  • The embedding of such third-party widgets does not violate the terms of service of the respective third-party platforms.

7. Intellectual Property Rights of Anakrio AS

The Services, including their underlying source code, database architecture, algorithms, interface designs, frontend components, graphics, logos, trademarks, domain names, documentation, and technical systems, are the exclusive property of Anakrio AS and its licensors, protected under Norwegian copyright legislation (Åndsverkloven), international treaty provisions, and global intellectual property laws.

Except as expressly authorized in writing by Anakrio AS, you shall NOT:

  • Copy, modify, duplicate, frame, reverse-engineer, decompile, disassemble, or attempt to extract source code from the platform.

  • Remove, obscure, or alter any copyright notices, trademark tags, or proprietary rights disclosures affixed to or contained within the Services.

  • Sell, lease, sublicense, distribute, or commercially exploit platform components to third parties on a white-label basis without an explicit enterprise partnership agreement.

8. Financial Terms, Subscriptions & Payment Governance

8.1 Subscription Plans & Billing Cycles

Certain advanced features, custom domain integrations, advanced analytics modules, and higher API rate quotas require paid tier subscriptions. By selecting a paid subscription tier, you authorize Anakrio AS (and our merchant-of-record payment processors, such as Stripe or PayPal) to charge your designated payment method on a recurring billing cycle (e.g., monthly or annually) in advance.

8.2 Automatic Renewal & Cancellation

Subscriptions automatically renew at the conclusion of each billing cycle unless explicitly canceled prior to the renewal date. You may cancel your active subscription at any time via your account management control panel located at https://anakrio.com/user/settingshttps://anakrio.com/user/settings. Cancellation halts future recurring charges; however, you will retain access to paid features until the expiration of the current paid billing period.

8.3 Price Adjustments

Anakrio AS reserves the right to modify subscription fees and service tier costs. We will provide at least thirty (30) days' advance notice of any price changes via email or dashboard announcements. Continued use of the Services following the effective price modification date constitutes acceptance of the new fee structure.

8.4 Refund Policy & Chargebacks

ALL PAYMENTS MADE TO ANAKRIO AS ARE NON-REFUNDABLE TO THE MAXIMUM EXTENT PERMITTED BY MANDATORY APPLICABLE LAW, EXCEPT WHERE REQUIRED BY CONSUMER STATUTES WITHIN THE EUROPEAN ECONOMIC AREA (EEA) OR NORWAY. Unilateral payment chargebacks initiated without prior direct resolution outreach to support@anakrio.com will result in immediate account suspension, permanent link deactivation, and referral to collections processing.

9. Privacy, GDPR & Data Processing

Data privacy, security, and statutory compliance are fundamental pillars of our service framework. The collection, use, transmission, and protection of personal data processing under this Agreement are governed strictly by our Privacy Policy, incorporated herein by reference.

  • Data Controller & Data Processor Roles: Under the European General Data Protection Regulation (EU 2016/679) ("GDPR"), Anakrio AS acts as a Data Controller regarding account registration metadata, billing records, and direct administrative communications. For end-user telemetric analytics generated through short links created by account holders, Anakrio acts as a Data Processor executing services under the direction of the User.

  • Self-Service Account & Data Erasure: Account Holders maintain full autonomy over their personal records. You may exercise your right to erasure ("Right to be Forgotten") and permanently purge your profile, hosted bio pages, redirection histories, and operational metrics at any time directly via https://anakrio.com/user/settingshttps://anakrio.com/user/settings.

10. Service Availability, Maintenance & SLA Disclaimers

10.1 System Uptime & Maintenance

Anakrio AS strives to maintain high server uptime and fast HTTP redirection latency across our distributed edge delivery networks. However, you acknowledge that continuous, uninterrupted, and 100% error-free platform availability cannot be guaranteed. Scheduled maintenance operations, emergency patch installations, cloud provider outages, upstream telecom failures, network congestion, and malicious cyberattacks (e.g., massive DDoS events) may cause temporary service interruptions.

10.2 Service Modifications

Anakrio AS reserves the right to pause, update, modify, or deprecate individual system endpoints, features, or external integrations at any time without liability, provided such changes do not fundamentally destroy the core value proposition of an active paid plan.

11. DMCA & Copyright Infringement Takedown Policy

Anakrio AS respects the intellectual property rights of creators and adheres to standard digital notice-and-takedown procedures consistent with global copyright standards and European electronic commerce regulations.

11.1 Takedown Notification Requirements

If you believe that content hosted on an Anakrio bio page or redirected via an Anakrio short link infringes upon a copyright you own or control, you may submit a formal Notice of Alleged Infringement to our designated Copyright Agent at support@anakrio.com. To be valid, your notice must include:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.

  2. Clear identification of the copyrighted work claimed to have been infringed.

  3. Precise identification of the infringing material, including the specific Anakrio URL (e.g., [https://anakrio.com/VNK42o](https://anakrio.com/VNK42o) or bio link) to enable location and verification.

  4. Your contact details, including full address, telephone number, and official email address.

  5. A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  6. A statement made under penalty of perjury that the information in your notification is accurate and that you are the legitimate copyright owner or authorized to act on their behalf.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE NORWEGIAN AND INTERNATIONAL LAW, THE SERVICES, PLATFORM ARCHITECTURE, APIS, DASHBOARD UTILITIES, BIO PAGES, AND REDIRECTION NETWORKS ARE PROVIDED ENTIRELY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

ANAKRIO AS EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE.

  • WARRANTIES THAT THE SERVICES WILL MEET YOUR SPECIFIC BUSINESS, COMMERCIAL, OR TECHNICAL REQUIREMENTS.

  • WARRANTIES THAT PLATFORM OPERATION WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, VIRUS-FREE, OR FREE OF CODING ERRORS.

  • WARRANTIES CONCERNING THE ACCURACY, RELIABILITY, OR LEGALITY OF ANY USER-GENERATED CONTENT OR THIRD-PARTY DESTINATION WEBSITES REACHED THROUGH REDIRECTION SHORT LINKS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE MANDATORY LAW, IN NO EVENT SHALL ANAKRIO AS, ITS DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, SUBSIDIARIES, AFFILIATES, AGENTS, LICENSORS, OR THIRD-PARTY INFRASTRUCTURE PROVIDERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF REVENUE, COMMERCIAL PROFITS, BUSINESS OPPORTUNITIES, SAVINGS, DATA, OR GOODWILL.

  • COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES.

  • PLATFORM DOWNTIME, UNEXPECTED REDIRECTION LATENCY, SYSTEM OUTAGES, OR LOSS OF ANALYTICS DATA.

  • UNAUTHORIZED ACCESS TO, ALTERATION OF, OR LEAKAGE OF YOUR TRANSMISSIONS, DATA STREAMS, OR CONTENT.

  • MALICIOUS ACTS EXECUTED BY THIRD PARTIES, INCLUDING VIRUSES, BOTNETS, OR CYBERATTACKS PASSED THROUGH REDIRECTION LINKS.

Absolute Liability Cap

IN ALL CIRCUMSTANCES, THE MAXIMUM AGGREGATE FINANCIAL LIABILITY OF ANAKRIO AS ARISING OUT OF OR RELATING TO THIS AGREEMENT, YOUR USE OF THE SERVICES, OR ANY INJURY SUSTAINED THEREFROM SHALL BE STRICTLY LIMITED TO AND SHALL NOT EXCEED THE GREATER OF:

  1. ONE THOUSAND NORWEGIAN KRONER (1,000 NOK); OR

  2. THE TOTAL AMOUNT OF SUBSCRIPTION FEES PAID BY YOU TO ANAKRIO AS IN THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to defend, indemnify, release, and hold harmless Anakrio AS, its parent entities, subsidiaries, officers, directors, employees, contractors, agents, and licensors from and against any third-party claims, liabilities, lawsuits, regulatory fines, damages, losses, and reasonable legal expenses (including legal costs and attorneys' fees) arising out of or in any way connected with:

  • Your access to, deployment of, or operational misuse of the Services.

  • Your violation of any provision contained within this Agreement or our Acceptable Use Policy.

  • Any User Content, links, images, or media hosted, displayed, or redirected via your account.

  • Your violation of any third-party intellectual property, privacy, publicity, or statutory right.

  • Unlawful activities or fraud conducted through shortened links generated under your account credentials.

Anakrio AS reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to fully cooperate with our legal defense strategies.

15. Term, Suspension & Account Termination

15.1 Agreement Term

This Agreement remains in full legal force and effect from the moment you first access the platform or register an account, and continues until terminated by either party in accordance with these Terms.

15.2 Termination by User

You may terminate this Agreement at any time by deactivating your account and purging your data via the self-service settings dashboard at https://anakrio.com/user/settings https://anakrio.com/user/settingsand permanently discontinuing all use of the Services.

15.3 Termination by Anakrio AS

We reserve the absolute right, without liability or financial penalty, to suspend, restrict, or permanently terminate your account, revoke API access, and purge hosted bio pages and redirection links immediately if:

  • You breach any covenant, warranty, or obligation under this Agreement or the Acceptable Use Policy.

  • We are required to do so to comply with a judicial warrant, court order, law enforcement command, or statutory directive.

  • Your account exhibits excessive chargebacks, unpaid subscription debts, or suspicious security anomalies.

  • We elect to permanently discontinue the platform or specific service operations.

15.4 Effect of Termination

Upon account termination, all licenses granted to you under these Terms shall instantly expire. Shortened URLs assigned to your account will cease routing end-users, and hosted bio pages will be rendered inaccessible. Sections 6.1, 7, 8.4, 12, 13, 14, 16, and 17 shall survive any termination of this Agreement.

16. Governing Law, Venue & Dispute Resolution

16.1 Choice of Law

This Agreement, its interpretation, and any non-contractual obligations or disputes arising out of or in connection with it or the Services shall be governed exclusively by, construed under, and enforced in accordance with the substantive laws of Norway, without regard to its conflict of law rules or principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

16.2 Exclusive Forum & Jurisdiction

Any legal claim, judicial dispute, lawsuit, or court proceeding arising out of or relating to these Terms or the Services shall be submitted to the exclusive personal jurisdiction of the competent district court of Norway (Sandefjord / Vestfold District Court (Vestfold tingrett) as the venue of primary instance). You irrevocably submit to the personal jurisdiction of such courts and waive any venue objections based on improper or inconvenient forum (forum non conveniens).

17. Miscellaneous Administrative Provisions

17.1 Revisions & Amendments

Anakrio AS reserves the right to revise, update, or modify this Agreement at any time to maintain statutory compliance, address system alterations, or introduce new operational standards. Material modifications will be communicated via email notifications sent to your registered primary email address or via prominent administrative alerts inside the user control panel at least thirty (30) days prior to the effective implementation date. Continued use of the platform after changes become active constitutes your full acceptance of the amended Terms.

17.2 Severability

If any specific clause, provision, or paragraph of this Agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force, validity, and effect.

17.3 Entire Agreement

This Agreement, alongside our Privacy Policy and any official written enterprise agreements executed between the parties, constitutes the entire legal agreement between you and Anakrio AS regarding your use of the Services, superseding all prior oral or written communications, proposals, representations, or understandings.

17.4 Force Majeure

Anakrio AS shall not be held liable for any failure or delay in performing its obligations under this Agreement resulting from causes beyond its reasonable control, including acts of God, war, terrorism, civil unrest, labor strikes, power grid failures, global internet infrastructure disruptions, severe fiber-optic cuts, or major cloud provider infrastructure outages.

17.5 Assignment

You may not assign, transfer, or delegate your rights or obligations under this Agreement without the express prior written consent of Anakrio AS. Anakrio AS may freely assign or transfer its rights and obligations under this Agreement in connection with a corporate merger, acquisition, structural reorganization, or sale of platform assets.
